éclat Law Files Civil Complaint Against New Port Richey, Seeking Over $2 Million in Damages for Wro

(Altamonte Springs, FL) April 4, 2023 — éclat Law, a firm based out of Altamonte Springs, Florida, has filed an eight count civil complaint on behalf of Marlowe Jones against the City of New Port Richey and its police department, Mayor, City Manager, former Police Chief, and three officers involved in wrongfully charging and arresting him in July 2020. The complaint is seeking over $2 million in damages exclusive of attorneys' fees, court costs, interest, and other administrative costs.
 
Attorneys Kevin Ross, Jolynn Falto, Nikki Pappas, and Crisol Lopez Palafox are representing Jones in this civil case. “Our client was wrongfully arrested and made to endure a criminal trial before being acquitted," said Attorney Ross. "We believe that the Defendants’ actions have caused our client to suffer substantial harm. Our goal is to seek justice for Mr. Jones and ensure that he receives the compensation he deserves."
 
The civil complaint asserts that Defendants deprived Jones of his First Amendment and Fourteenth Amendment rights within the meaning of 42 U.S.C § 1983. The complaint further asserts the following causes of action: Failure to Train, False Arrest, Malicious Prosecution, Abuse of Process, Civil Conspiracy, Intentional Infliction of Emotional Distress, and even Battery.

The lawsuit seeks monetary compensation for Jones of over $2,000,000.00, citing actual damages, compensatory damages, consequential damages, and punitive damages, among others for mental anguish suffered by Jones as a result of the wrongful arrest and criminal prosecution as well as punitive damages against each Defendant for their conduct towards Jones which was willful or wanton disregard for his constitutional rights protected by federal law.
