The Psychology that Drives Settlement: Understanding Loss, Risk, and Resolution
In this seminar, we examine the hidden psychological forces that shape settlement negotiations, with a focus on how cognitive biases, especially loss aversion and risk perception, govern behavior at the bargaining table. Drawing from behavioral economics and the RECO Method (Realistic Exposure to Catastrophic Outcome), we explore how to use framing, endowment effects, and worst-case scenario analysis to break deadlocks and motivate resolution.
