A significant change to the mortgage industry is now in effect, bringing greater privacy protections to homebuyers across Florida and the nation. The Homebuyers Privacy Protection Act (H.R. 2808) officially took effect on March 4, 2026, largely banning the sale of mortgage “trigger leads.”
For years, when a lender pulled a borrower’s credit for a mortgage application, credit bureaus were permitted to sell that inquiry data to other lenders. As a result, many homebuyers experienced an overwhelming wave of unsolicited phone calls, emails, and text messages—often within minutes of submitting a mortgage application.
Under the new federal law, credit bureaus are now largely prohibited from selling mortgage inquiry data to competing lenders.
